Terms of Inspection: Pre-Purchase

1. Fees, Cancellation, and Exclusions:

  • In consideration of the vehicle inspection services provided by 5 Point Inspect, including the issuance of an inspection report and any accompanying files or services where applicable, you agree to remit the applicable fees as delineated at the time of purchase.

  • 5 Point Inspect reserves the right to adjust fees periodically, with any revisions posted where the service is available for purchase, or as otherwise stipulated in these terms and conditions.

  • A minimum of 24 hours' notice is requested for inspection cancellations. Cancellations made with 24 hours' notice or more entitle you to a full refund. Cancellations with less than 24 hours' notice may incur a cancellation fee.

  • 5 Point Inspect retains the right to decline a vehicle inspection for any type of vehicle or item, with a corresponding entitlement to a refund.

2. Inspection Process:

  • 5 Point Inspect refrains from assembling, erecting, dismantling, or disturbing any structure, fixture, assembly, component, or internal/external mechanisms during the inspection.

  • Connection of the vehicle to any power source is not within the scope of inspection. The vehicle should be positioned and assembled on a safe and level surface with adequate walking space around its perimeter. Failure to meet these conditions may lead to inspection cancellation, with a full refund provided if 24 hours' notice is given.

3. Pre-Purchase Inspection Report:

  • The inspection conducted by 5 Point Inspect is visual and non-mechanical in nature. 5 Point Inspect assumes no responsibility for latent defects that were not visually apparent during the inspection.

  • The inspection does not involve the removal of parts or components, and the provided report is not exhaustive. While inspectors use accepted fault detection methods, not all faults may be identified.

  • The report's validity is limited to the time of issuance and is based on the vehicle's condition at the time of inspection.

  • It is the buyer's responsibility to visually inspect the vehicle at the point of sale, as the report reflects the vehicle's condition at the time of inspection.

4. Road Test (if included):

  • If a road test is part of the inspection, the vehicle must have sufficient petrol for the test. 5 Point Inspect reserves the right to refrain from testing if, at the inspector's discretion, the vehicle is deemed not roadworthy or is unregistered.

  • Road tests are conducted within the local speed limit.

5. Considerations and Disclaimers:

  • The age and condition of the vehicle should be considered when reviewing the inspection report.

  • 5 Point Inspect does not provide any warranty regarding the nature, reliability, accuracy, or completeness of the information contained in the report.

  • The report is not a roadworthy certificate and cannot substitute for one. Vehicle owners should contact the relevant road transport authority for roadworthy certificate requirements.

  • 5 Point Inspect does not check for manufacturer recall notices, and vehicle owners are advised to verify the absence of any recalls.

  • Despite inspection results, 5 Point Inspect does not guarantee that the vehicle would pass a road authority inspection.


Pre-purchase inspections (e.g. car, bike, caravan): We will not be responsible for any latent defects that are discovered which were not visually apparent at the time of the inspection.

Whilst our inspectors use accepted methods for fault detection, these methods may not necessarily identify all faults with a vehicle. As the scope of the inspection is limited (as described in these Inspection Service Terms), the faults listed in the Report (if any) are not intended to be an exhaustive list of all faults with the vehicle, and should not be relied upon as such. The Report is only current as at the time it is issued and is based on an assessment of the vehicle at the time of inspection. It is your responsibility (as a buyer) to conduct an inspection of the vehicle at the time of sale, as we can only advise on the condition of the vehicle at the time of our inspection. You should consider the age and condition of the vehicle at the time of inspection and any Report should be reviewed in this context. We do not check for any manufacturer recall notices and you should check that the vehicle is not subject to a recall notice. We do not assess the vehicle for compliance against the manufacturer’s factory specifications (e.g. the Report does not consider whether vehicle trim aligns with a manufacturer’s factory specifications, or if a non-standard vehicle badge is installed on a gear knob). The Report is not a roadworthy certificate and cannot be used as a roadworthy certificate – you should contact the road transport authority in your state or territory for roadworthy certificate requirements. Notwithstanding the result of any inspection, we do not guarantee that the vehicle inspected would pass a road authority inspection. You are solely responsible for undertaking searches of public records in relation to the vehicle, for example to determine if the vehicle is subject to a security interest, the vehicle has been written off or the VIN or engine number of the vehicle is inauthentic or any other matter. We will also not be responsible for verifying the accuracy of the vehicle mileage as indicated by the vehicle’s odometer. Subject to all applicable laws, we do not provide any warranty regarding the nature, reliability, accuracy or completeness of any information contained in the Report or the fitness of the information contained in the Report for any purpose intended.

Terms of Service - Roadworthy Inspection

5 Point Inspect, having received approval from the Queensland Department of Transport and Main Roads ("TMR"), proudly serves as an authorized provider of vehicle inspection services in Queensland. We specialize in facilitating the acquisition of both Queensland Safety Certificates and Certificates of Inspection for vehicles seeking registration within the state.

1. Queensland Safety Certificate Services: Our inspections for Queensland Safety Certificates are tailored to vehicles in Queensland that require registration. These assessments adhere to the stringent guidelines outlined by the Queensland Vehicle Inspection Guidelines.

  • Upon successful completion of the inspection and meeting the stipulated requirements, 5 Point Inspect will issue a Queensland Safety Certificate.

  • In the event of non-compliance, our inspectors will provide a detailed explanation of the reasons for the vehicle's failure. Customers are granted a 14-day window to address identified issues and schedule a re-inspection with us.

  • No additional fees will be charged for a re-inspection if scheduled at a fixed location within the specified timeframe. However, please note that travel charges may apply for mobile re-inspections.

  • For information on whether a Queensland Safety Certificate is required in your specific situation and details on certificate validity, please refer to the Queensland Government website.

2. Certificate of Inspection Services:5 Point Inspect is also authorized by the Queensland Department of Transport and Main Roads ("TMR") to issue Certificates of Inspection for specific vehicle categories requiring this certification. This service is exclusive to vehicles located in Queensland and intended for registration within the state.

  • Our inspections align with the stringent requirements detailed in the Queensland Vehicle Inspection Guidelines.

  • A Certificate of Inspection will be issued upon confirmation that the vehicle meets the outlined requirements.

  • Non-compliance results in a detailed explanation of the reasons, allowing customers 14 days to rectify identified issues and schedule a re-inspection with us.

  • No additional fees are applicable for re-inspections if conducted at a fixed location within the provided timeframe. However, travel charges may apply for mobile re-inspections.

  • For information on whether a Certificate of Inspection is required in your specific circumstances and details on certificate validity, kindly consult the Queensland Government website.

Important Notes:

  • 5 Point Inspects fees are comprehensive, encompassing both service and travel costs.

  • We emphasize that we do not provide any representation or warranty regarding the condition of the vehicle. Therefore, we recommend conducting a thorough mechanical inspection and other investigations of the vehicle for your assurance.

Customer Responsibilities

Your Responsibilities:

 

1. Inspection Location and Responsibilities:

  • The inspection will be conducted at the location notified by you or the relevant vehicle seller to 5 Point Inspect.

  • It is your responsibility to ensure that your vehicle is present at the specified inspection location at the scheduled booking time. Alternatively, you must coordinate with the vehicle seller to make the vehicle available for inspection.

2. Confidentiality of Inspection Report:

  • The inspection report provided by 5 Point Inspect is intended solely for the person named on the report.

  • You must not disclose the report to any third party without prior written consent from 5 Point Inspect.

3. Pre-Purchase Inspections Responsibilities:

  • If the inspection is for a pre-purchase, you are responsible for conducting searches of public records related to the vehicle.

  • You must verify if the vehicle has a security interest, has been written off, or if the VIN or engine number is inauthentic.

  • 5 Point Inspect is not responsible for verifying the accuracy of the vehicle's mileage as indicated by the odometer.

4. Disclosure of Information:

  • You must provide the 5 Point Inspect inspector with any material information regarding the vehicle under inspection.

  • This includes the vehicle's service history, registration status, major mechanical repairs, or structural damage due to collisions.

5. Limitation of Report's Use:

  • The inspection report is not a recommendation to purchase or not to purchase a vehicle.

  • The decision to purchase a vehicle rests solely with you, based on your own circumstances, investigations, and considerations.

6. Liability:

  • Except as explicitly stated in this clause, and to the fullest extent permitted by law, all rights, remedies, conditions, guarantees, and implied or express warranties are excluded.

  • 5 Point Inspect's liability is limited to specific options, including replacement, repair, or supply of services, as outlined in the agreement.

  • 5 Point Inspect will not be liable for indirect or consequential loss or damage, including loss of use, production, profit, revenue, business, data, or economic loss.

7. Intellectual Property:

  • All Intellectual Property Rights in 5 Point Inspect services are vested in 5 Point Inspect.

  • No assignment of Intellectual Property Rights in materials provided by 5 Point Inspect to you is made as part of the service provision.

8. Termination:

  • Either party may terminate this agreement with immediate written notice in the event of a breach.

  • Termination may occur if the breach is incapable of remedy or if the other party fails to remedy a remediable breach within 14 days' written notice.

9. Force Majeure:

  • 5 Point Inspect will not be liable for any delay or failure in performing an inspection due to events or circumstances beyond its reasonable control.

10. Privacy:

  • 5 Point Inspect collects, holds, and discloses your personal information in accordance with the 5 Point Inspect Privacy Policy.

11. Amendment:

  • 5 Point Inspect may modify or amend the terms and conditions, providing 30 days' notice via your nominated email address or through the 5 Point Inspect website.

12. Governing Law:

  • This agreement is governed by the laws of the State of Victoria, Australia, and both parties submit to the exclusive jurisdiction of the courts in that state.

 

Attachment 2 - Excluded Items List

In addition to the inspection scope constraints detailed in the Inspection Service Terms above, our inspection service does not involve inspection of the following items:

  1. Excluded items for car inspections

    1. Brake function and lining material, brake drums, limited to what is immediately visible

    2. Evidence of brake fluid contamination/hydraulic fluid

    3. Anti-lock braking system (ABS) mechanics

    4. Meters indicating oil and fuel consumption or the degree of oil and fuel consumption

    5. Reason for oil leaks

    6. Oil pump strainer to assess sludge build up

    7. Wheel cylinders

    8. Hybrid/electric car batteries (start-up battery is checked)

    9. Vehicle electrics and electronics

    10. Transmission mechanics

    11. Engine cylinder compression

    12. Engine/motor mountings

    13. Water pump/fan

    14. Body water leaks or reason for leaks

    15. Odometer and camshaft belt, drive belt and timing belt

    16. Fuel/charging flap release

    17. Estimated expiry of exhaust system, clutch, dual mass flywheels

    18. Standard to which repairs or service history have been completed

    19. Functionality of audio-visual or entertainment system including CD, Cassette, TV, DVD, iPod connectivity, sensors, alarm/security devices, satellite navigation systems/GPS

    20. Degree of gas emissions

    21. Catalytic converters

    22. Additional accessories included as a result of owner’s modifications

    23. Mechanical switching of wipers and lights

    24. LPG systems

    25. Air conditioning efficiency

    26. Status of habitation areas of motorhomes or caravans

    27. Vehicle’s computer systems, such as trip meter computers, cruise control and any other computer systems

    28. Technical systems

    29. Driver assistance technologies (e.g. lane keeping assistance, adaptive cruise control, blind spot monitoring, collision avoidance systems)
       

  2. Excluded items for bike inspections

    1. Brake function and lining material, brake drums, limited to what is immediately visible

    2. Evidence of brake fluid contamination/hydraulic fluid

    3. Anti-lock braking system (ABS) mechanics

    4. Meters indicating oil and fuel consumption or the degree of oil and fuel consumption

    5. Reason for oil leaks

    6. Oil pump strainer to assess sludge build up

    7. Wheel cylinders

    8. Vehicle electrics and electronics

    9. Transmission mechanics

    10. Engine cylinder compression

    11. Engine mountings

    12. Water pump/fan

    13. Body water leaks or reason for leaks

    14. Odometer

    15. Estimated expiry of exhaust system, clutch, dual mass flywheels

    16. Standard to which repairs or service history have been completed

    17. Functionality of audio/entertainment systems

    25. Heated handle grip and seat operation

    26. Engineering or compliance of any accessory or sidecar attachment

    27. Wheel alignment (handlebar, wheels, final drive)

    28. Tyre pressures

    29. Wheel spoke tension

    30. Engine Overheating

    31. Frame and swingarm alignment

    32. Condition of internal engine and gearbox components

    33. 2 Stroke Oil Pump Operation and adjustment

    34. The operation and/ or roadworthiness of any non-genuine parts and accessories fitted, for example aftermarket exhaust systems

    4. Dimensions and towing restrictions (in relation to which it is the buyer’s responsibility to check prior to purchase)

    6. Electric expendable living areas

    7. Roof condition where a lift or ladder is required to view and assess

    8. Status of habitation areas

    9. Air conditioning efficiency

    10. LPG systems

    11. Mechanical switching of lights, switches and plugs

    12. Additional accessories included as a result of owner’s modifications

    13. Degree of gas emissions

    14. Functionality of audio-visual or entertainment system including CD, Cassette, TV, DVD, iPod connectivity, sensors, alarm/security devices, satellite navigation systems/GPS
